Asylum

Protection in the United States for those who fear persecution in their home country.

Asylum in New York

Asylum offers protection to people who fear persecution in their home country because of their race, religion, nationality, political opinion, or membership in a particular social group. If granted, asylum allows you to remain in the United States, work legally, and eventually apply for a green card.

Asylum cases depend heavily on a well-documented, well-told account of what happened to you and why you cannot safely return home. We take the time to understand your story fully and build your case around clear, credible evidence.

The One-Year Filing Deadline

You generally must file for asylum within one year of your last arrival in the United States. There are exceptions for changed circumstances affecting your eligibility or extraordinary circumstances that caused the delay. Missing the deadline does not always end your case, but it makes timely legal advice especially important.

Affirmative vs. Defensive Asylum

  • Affirmative asylum is filed with USCIS when you are not already in removal proceedings
  • Defensive asylum is raised as a defense in immigration court when you are in removal proceedings
  • Both paths require the same underlying legal standard, but the process and forum are different
  • We handle both affirmative applications and defensive cases in immigration court

Both provide similar protections, but refugee status is granted to people outside the United States before they arrive, while asylum is granted to people who are already in the United States or arriving at a port of entry.

Yes, your spouse and unmarried children under 21 who are in the United States can generally be included in your application as derivatives.

You can still apply for asylum defensively in immigration court as part of your removal proceedings. We represent clients in both affirmative applications and defensive cases before the court.
